Molecular Probes has two offices that serve the needs of the global research community (see contact information below). Orders may be placed by phone, fax, mail or e-mail. For your added convenience, our Web site (www.probes.com) features online order forms as well as the entire Handbook contents, full product information, and more. Products may also be purchased through one of our many full-line distributors around the world (see Distributors).

Molecular Probes has offices in Eugene, Oregon, USA and in Leiden, The Netherlands. Molecular Probes, Inc. in Eugene serves customers from North America, Central America, South America, Asia (excluding Japan and India), Australia, New Zealand, Pakistan and islands in the Pacific. Customers in Japan and India are served only by local Distributors. Molecular Probes Europe BV in Leiden, The Netherlands handles all accounts in Europe, Africa, the Middle East and Russia; orders from these areas must be placed with the Leiden office or through one of our authorized Distributors.

Payment Terms

Invoices are sent within 24 hours of shipping the order. Terms of payment are net 30 days from the date of shipment. The amount received must be sufficient to cover both the invoiced amount and any bank charges that may be incurred. Late charges may be added to invoices not paid within the 30-day time period. Late charges must be paid before subsequent orders can be shipped. Shipments will be suspended if payments are not received within the specified time, and subsequent orders may be held until all overdue payments from the entire institution from which the order was received are paid in full.

Molecular Probes, Inc. (Eugene, Oregon, USA), requires payments to be made by check in U.S. dollars, drawn on a U.S. bank, or by bank transfer to the address on the invoice. Molecular Probes, Inc., accepts Visa, MasterCard and American Express. When paying with a credit card, please include the full name and account number of the cardholder and the expiration date of the card.

Molecular Probes Europe BV (Leiden, The Netherlands) invoices in euros and in local currencies in a few European countries. Molecular Probes Europe BV has set up accounts at banking institutions in most European countries. Customers can make payments by direct deposits payable to Molecular Probes Europe through these banks, at the account number stated on the invoice. Molecular Probes Europe also accepts Visa or MasterCard. When paying with a credit card, please include the full name and account number of the cardholder and the expiration date of the card. We reserve the right to adjust prices and to modify exchange rates to cover currency fluctuations.

Method of Shipment

Shipping is FCA (Free Carrier; Eugene, Oregon, USA, or Leiden, The Netherlands) Incoterms 2000 (for information on Incoterms, see http://www.iccwbo.org/index_incoterms.asp). Orders are sent to customers by the best method both for protecting the products during transit and for meeting commitments on delivery dates. Products, even those for which freezer storage is recommended, are stable for the period of shipment. Some products must be shipped cold without freezing by the fastest practical method. A fee will be added for items requiring dry ice or extra ice packs necessitated by long delivery time. At all times, Molecular Probes will adhere to government regulations for packaging and shipping.

Return Goods Policy

Please inspect your packages upon receipt. If the goods have been damaged in transit, our Customer Service Department can assist you in filing a claim with the carrier. Please inform us immediately of any shortage or shipment errors. Any claims for such errors must be made within ten business days. If it is our error, we will do whatever is necessary to ship the correct products as soon as possible. Our Customer Service Department must authorize any returns. We will not accept return shipments unless we have given prior written permission and shipping instructions.

In many cases, items ordered in error cannot be returned because of the sensitive nature of many of our products and the difficulty and expense of requalifying returned items. If items are accepted for return, they must be in new, unopened, unused and undamaged condition, and you will be charged a per-unit 20% restocking charge. Molecular Probes will advise you on the method of packing, labeling and shipping. To ensure proper credit, each return item must include the purchase order number, invoice number and return authorization number.

Research and Development Use Restriction, Material Safety

Except as provided by written contracts, products ordered from Molecular Probes are sold for research and development use only. They are not intended for food, drug, household, agricultural or cosmetic use. The buyer assumes responsibility to ensure that the products purchased are approved for use under the Toxic Substances Control Act (TSCA), if applicable.

Use of Molecular Probes' products must be supervised by a technically qualified individual. A material safety data sheet (MSDS) accompanies products defined as hazardous by the U.S. Occupational Safety and Health Administration (OSHA) Hazard Communication Standard. Other products are accompanied by a letter stating that no MSDS is required.

Disclaimer of Warranty, Remedy and Liability

The products shipped by Molecular Probes are warranted to conform to the technical descriptions provided in our publications. Molecular Probes does not warrant or guarantee that its products are merchantable or satisfactory for any particular purpose, nor free from any claim of foreign or domestic patent infringement by a third party, and there are no warranties, express or implied, to such effect. Molecular Probes will not be liable for any incidental, consequential or contingent damages involving their use. Our responsibility is limited only to replacement of items ordered.

We reserve the right to discontinue or change specifications or prices and to correct any errors or omissions at any time without incurring obligations. Molecular Probes will not be responsible for claims made by any of its distributors that exceed those made in Molecular Probes' own publications. All orders for Molecular Probes' products placed through our distributors are subject to the prices, terms and conditions set by the distributor; these may differ from those of Molecular Probes.
